How to obtain the right to health care
PERSONAS CON PADRÓN
en situación irregular
- Proof of 3 months of stay in Spain with documents such as passport or any other document, such as padrón, plane tickets, bus tickets...
- You must be registered at the time of application. Attention! One day of census registration is sufficient.
- You must present a valid identity document.
- Where to go? Present all the documentation at the Osakidetza Health Care Centre closest to your home or place of stay.

1. Solicitantes de Asilo o Apatridia (Protección Internacional) pueden tener derecho desde el primer día, pero dependiendo del documento y del tiempo de estancia , el documento será temporal por 6 meses.
- You must present the police document and the census.
- Attention: In some health centres they ask for a passport (forgetting the health card or/status document). These last two ones gives them more rights than passport. The asylum/ statelessness ensures more protection than passport.
- Where to go? They should go to the Foreigners' Office or to the the nearest Asylum and Refuge Centre (OAR) to apply for the temporary document.

2. People in an irregular situation who do not have Social Security registration:
- Try to get the document from the INSS (National Institute of Social Security), and in case of refusal, contact the Base Social Services to ask for a favourable report.
UNREGISTERED PERSONS
CLARIFY WHETHER THE PERSON CONCERNED FALLS WITHIN ONE OF THE CASES RECOGNISED BY INSTRUCTION 1/2023
1. Refusal to register with a municipality (less than 3 months old).
2. Certificate of visits to social services (at least 2 visits in the last 3 months).
3. Certificate of enrolment in an educational centre (less than 3 months old).
4. Certificado de escolarización de hijos (menos de 3 meses) y documento de filiación.
5. Registro de asistencias médicas (al menos 2 visitas en los últimos 3 meses).
6. Document certifying social benefits (less than 3 months).
Any person with an identity card (passport/NIE/DNI) who does not have a padrón, can substitute it through one of the above mentioned documents. This will allow them to access health services.
In the case of undocumented migrants, some non-profit organisations, such as Doctors of the World, may be able to certify their length of stay. With this document, and after making the application, you will obtain a 6-month Health Care Document. This document can be renewed with a new application.
REUNITED FAMILY MEMBERS
ARE OBLIGED TO TAKE OUT PRIVATE INSURANCE, WITHOUT PUBLIC COVERAGE.
- Reunited family members who are minors and spouses (0 equivalent) can be included as beneficiaries of the reuniting person, however, relatives in the ascending line cannot. It is the ascendants who are obliged to take out private insurance.
